Acceptance of Terms & Eligibility
By using our Services, you represent and warrant that you have read, understand, and agree to be bound by these Terms and Conditions of Service. As well as all other rules, policies, and procedures related to our services
Our Terms and Conditions (“Terms” or “Agreement”) are entered into by and between you and Eternal Designs (“Eternal Designs,” or “we,” or “us,” or “our”). Eternal Designs provides a range of services from custom apparel decoration through screen printing, embroidery, heat press transfers, and vinyl. We also provide printed products through our third-party vendors. Accessible through our website. (hereinafter, “Service” or “Services”). We make our Services available through our website: https://eternaldesigns.co/.
By entering into this Agreement, you represent and warrant that you are at least 18 years old. If you are entering into these Terms on behalf of a legal entity, you represent and warrant that you have the authority to bind this legal entity.
Minimums
A minimum order quantity is required for all apparel projects and Services. These Services include, but are not limited to, screen printing, embroidery, print transfers, and patches. The minimums are applied based on the number of print colors and artwork complexity. Eternal Design reserves the right to waive minimums on a case-by-case basis.
Screen Printing
- 24 pieces – 1 - 3 color design
- 48 Pieces – 4 - 5 color design
- 72 Pieces – 6+ color design
Embroidery
- 12 pieces – 6000 -10,000 Stitches
- 24 pieces – 10,000 stitches+
Uniforms
- 8 pieces (Vinyl Application) – 1- 2-color design
- 12 pieces (Transfer) – Multi-colored
- 12 pieces (Sublimated Uniforms) – Multi-colored, cut & sew
Minimum order quantities only apply to one size range. Customers are not allowed to mix sizes from adult, youth, and toddler without meeting the minimum size requirement for the stated size. If you would like to add youth or toddler sizes to your order, a minimum quantity is required:
Youth/Toddler
- 24 pieces – 1 - 4 color design
- 48 Pieces – 5+ color design
Garment selection and subjectivity
Eternal Designs suggests all garments for each order based on your specified specs and requests. We will do our best to assist with the garment selection process by providing all-digital images of colors, sizing, and information regarding the selected garment. If you have a specific garment request and you are more particular regarding the garment. We strongly encourage ordering blank samples of the garments before placing an order. We can’t guarantee customers will like the garment they choose. We can only guarantee print quality. The customer is solely responsible for the garment they select, not Eternal Designs. Blank samples are not free and must be paid for.
Quote/Sales Orders/Invoice
All written pricing provided by Eternal Designs—including quick quotes, official quotes, sales orders, and invoices—is valid for 15 business days from the date it is issued.
Orders placed after this 15-day period will require a new quote and may be subject to updated pricing. Eternal Designs reserves the right to re-quote any project affected by changes in product availability, material costs, or supplier pricing. Final pricing is subject to review and confirmation based on complete order specifications and approved artwork.
Digital Proofs & Artwork Approval
Eternal Designs provides digital proofs for each project. These proofs may include the following details:

Ink or thread type and color (colors are based on Coated and Uncoated Pantone color guides and the Gunold thread color chart)

All apparel and item proofs are made available digitally through the client portal.
Approval of a sales order constitutes approval of the associated digital proof. Once an order is approved, Eternal Designs is not responsible for errors that were visible or contained within the approved proof, including but not limited to spelling, layout, color, sizing, or placement. Any items printed incorrectly due to these approved details will be reprinted at the customer’s expense. If an error is caused by Eternal Designs during production (not present in the approved proof), we will either repair/replace it at our discretion.
Each project includes up to three (3) digital proofs. Additional proofs requested beyond this limit will be billed at $15.00 per proof.
Artwork
All submitted artwork must be print-ready at 300 DPI or higher, vector-based artwork, in one of the following file formats: Adobe Illustrator (.ai), Adobe Photoshop (.psd), Encapsulated PostScript (.eps), Portable Document Format (.pdf), and Tagged Image File Format (.tif). High-resolution 300 DPI photographic raster-based artwork will be accepted. JPEGs are generally not acceptable for quality reproduction work. Microsoft Word (.doc), Excel (.xls), PowerPoint (.ppt), Graphics Interchange Format (.gif), Bitmap (.bmp), and Rich Text Format (.rtf) are not acceptable formats. Artwork should be sized to print, and all text must be converted to outline or rasterized. For artwork that is received that is too small or poor in quality, you will be asked to provide better artwork. If better artwork is not received, the artwork will be printed as is unless touch-ups or clean-ups are requested. Total clean-up, recreations, or custom creations will be billed at a rate of $50.00 an hour. (Minimum one hour) This fee will be discussed and approved with you before we start. The artwork fee must be paid in full and is nonrefundable. Turnaround time for artwork creation can take anywhere from 3 - 5 business days to 2 weeks, depending on the artwork requirements.
Artwork Submission
Artwork can be submitted to us in several ways:
- Email artwork (24MB or less) to orders@eternaldesigns.co.
- Email a link to artwork (Dropbox, Google Drive, etc.)
- Uploaded on our website.
- Bring in your artwork on a portable thumb drive or device
Artwork/Print placement
Artwork placement shown on digital mockups should be considered approximate print placement, not actual print placement. Garments come in different styles, sizes, and shapes, and are moveable, stretchable canvas that could alter the artwork's actual print placement. We do our best to ensure the artwork is printed and placed in the desired print location. Note: It is the customer's responsibility to provide details regarding print placement and size. If no details are provided, Eternal Designs will choose the best placement and size for any artwork provided. The actual print placement will vary by 1/4 in. in any direction, regardless of garment size. We are not liable for any design printed in the wrong place and in the wrong size if not stated before placing your order. Artwork accepted angle variance is plus or minus 10 degrees per garment.
Any printing on or over seams, zippers, collars, or hems will likely result in printing inconsistencies and distortion. These inconsistencies are considered accepted goods and will not be considered misprints.
Image Size on Different Garments
The image size of the artwork is printed the same size on all garment sizes unless otherwise specified. Different image size artwork will be billed as a separate order and applies to youth and toddler sizes.
Payments
Payment for all orders is required upfront and in full. Eternal Designs cannot begin any project until payment has been received.
Requests to pay a deposit may be considered; however, approval is not guaranteed and is evaluated on a case-by-case basis. Requests for Net 15 or Net 30 payment terms are also reviewed individually and must be submitted in writing via email.
Accounts that are 16 days past due for Net 15 terms or 31 days past due for Net 30 terms are considered delinquent unless otherwise specified in writing. Late fees are calculated as 3% of the outstanding balance per week starting the day after the due date, capped at 8 weeks. A 3% late fee will be applied per week for up to eight (8) weeks or 60 days. If payment is not received within this period, Eternal Designs reserves the right to pursue legal action to recover the outstanding balance.
All rush orders require full payment in advance, including any applicable rush fees. Rush charges are determined based on project timeline and production requirements.
All payments are non-refundable after 24 hours from the time the order is placed.
Accepted payment methods include online payments or in-person payments by debit card, credit card, cash, or check. For orders exceeding $2,000.00, check or ACH payments are strongly encouraged.
Checks must be made payable to Eternal Designs. Checks not delivered in person should be mailed to PO Box 2487, Rome, GA 30164. A $50.00 fee will be assessed for any returned checks.
All credit card payments submitted through the Eternal Designs Client Portal are subject to a 3% + $0.30 processing fee, which will be added to the total transaction amount.
Minimum Invoice Amount
All orders are subject to a minimum total value of $175 per order. Additional costs like art, finishing services, shipping, and sales tax do not contribute to the minimum order total.
Rush orders
Print quality is our priority. If we can accommodate a rush order without jeopardizing the quality of a product, we will accept the rush order. Rush orders are subject to a rush fee. The rush fee is based on anything sooner than 5 days. The rush fee is a percentage-based dollar amount based on the total sale amount. The rush fee percentages are as follows:
- 5 business days – 50%
- 3 business days – 75%
- 1 business day – 100%
24-hour rush orders may be available under certain circumstances. Please contact us via email at orders@eternaldesigns.co to discuss your project.
After Payment
For all approved and paid orders. There is a 24-hour window where you are allowed to make changes or add products to your order. After 24 hours, any changes made by you to your order not caused by stock availability, supplier issues, or fulfillment errors will not be allowed without incurring fees. A standard charge order fee of $35.00 is applied to your order, along with any other fees (restocking, shipping, etc.) for changes or add-ons made to your order after the 24-hour window. These fees will be invoiced to you immediately.
Order Cancellation
Orders may be canceled only at the following stages:
- Before the order is approved and paid, or
- Within the 24-hour change order window after approval and payment
The 24-hour change order window begins after an order has been approved and paid and is calculated using business days, Monday through Friday. This window does not include weekends (Saturday and Sunday).
Once the 24-hour change order window has passed, orders can no longer be canceled, and all payments are considered non-refundable. This policy applies to all orders, including rush orders.
Turnaround Time
Our standard turnaround time is approximately 8 to 10 business days (Monday – Friday). Orders that include specialty inks and add-on services like retail finishing or packaging may increase turnaround time. During busy times, the turnaround time is extended to approximately 10 to 15 business days. Turnaround times do not include time in transit. If there is a hard-in-hand date or if you need your order sooner, you can opt to have your job “Rushed”. Please specify your in-hand date at the time your order is placed. Eternal Designs is not responsible for any deadlines missed due to any unforeseen reason, including, but not limited to, weather conditions, vendor shortages or errors, shipping errors, or power outages. You will be notified of any such delays or issues caused by vendors or issues that may have occurred during production. Time-sensitive jobs should be planned out in advance. Turnaround times are not guaranteed
Shipping
Shipping pricing varies depending on location, weight, and priority. We generally ship all packages via UPS, although USPS (United States Postal Service) is also used as an alternative. The use of a shipper’s account (UPS) is allowed if provided to us before the completion of your project. The transit time is not included in your order turnaround time calculation. Click HERE to view a map of estimated transit days. Once your order is delivered to one of our shipping partners, we cannot guarantee the exact delivery date, nor are we responsible for any shipping delays. Split shipping is available for certain orders. Please let us know when placing your order if your order needs to be split shipped. An additional charge may apply if we are not aware of the split shipment before the start of your order. Currently, Eternal Designs does not ship internationally. Click HERE to view a list of carrier closure days, which may affect your order. Shipping delays do not qualify for refunds of an order or rush fees, unless the delay was created by Eternal Designs.
Packaging
All orders are bulk packaged unless otherwise specified. For orders that require Individual folding, bagging, and tagging. Please specify how these items should be packaged and handled. If not specified, Eternal Designs will package these items as we see fit.
Over Run
Occasionally, we may accidentally order extra or receive extra shirts/products from our distributors. When this happens, we normally print the extras. These extra shirts/products are just thrown into your order. If we do, you are never charged for these.
Blanks
Eternal Designs will not provide blank garments under any circumstances for any reason. Any requests for the purchase of blank garments will be rejected. However, when considering what style of garment should be used for a project, the purchase of sample blanks is allowed. The purchase of sample blanks is limited to 10 items per customer, per project. These items must be paid for before providing samples. We cannot guarantee you’ll be happy with any suggested product you decide to purchase as a sample.
Garment/Product Availability
Eternal Designs provides printing on a wide variety of brands, styles, colors, and sizes. Eternal Designs does not stock blank garments/products in-house, as garments /products are ordered on an as-needed basis. From time to time, vendors may run short or may be completely out of stock of certain items, which could affect your order. Eternal Designs is not held liable for production delays due to product availability or discontinued items. Customers will be notified via email immediately of any shortage or availability and provided with other options. After being notified regarding a viable replacement option, the customer has up to two business days to pick an alternative product. Eternal Designs reserves the right to substitute any garments/products for a suggested alternative if the replacement request is not answered within two business days. Eternal Designs can put your order on hold until the initial items are restocked. Note: The initial turnaround time given for all held orders is no longer guaranteed.
Provided Garments
Due to issues with garment quality, garment sanitation, and print control, Eternal Designs will no longer accept customer-supplied garments under any circumstances. Eternal Designs must provide garments for all customers' custom print orders. This doesn’t apply to, nor does it affect, contract vendors. Eternal Designs does reserve the right to waive this in certain situations, as we recognize that we are unable to source certain garments.
Provide Garments (Contract)
When possible, garments must be reviewed by us before we agree to print on them. We will not inspect each garment provided to us. Eternal Designs is not responsible for the replacement or repair of any manufacturer-defective garment, including but not limited to mislabeling, inconsistent sizes or colors, stitching errors, rips, tears, holes, stains, etc. We highly suggest supplying a few extra garments of each size for this purpose. If these garments are not used, we will send them back along with your order. Eternal Designs reserves the right to refuse any garments supplied by the client that we deem unsuitable for print. The client is responsible for ensuring their garments are free of any defects and flaws before delivery. Eternal Designs can only guarantee print quality within our spoilage percentage.
Defects
Eternal Designs is not responsible for any defects caused by the manufacturer or distributor. This includes, but is not limited to, defects in the form of inconsistent coloring, mislabeled sizes or inconsistencies, loose stitching, holes or tears caused during manufacturing, and inconsistent fabric blends, dye issues, bent products, or standard product function. We do our best to inspect garments/products and replace any defective garments/products before they are printed. If any defects are not caught by our quality control team, any defect found in your order falls under our misprint allowance/spoilage rate. The ordering of extra garments is encouraged if the exact number is required.
Customer Satisfaction
Orders picked up or shipped must be verified for quality and accuracy within 72 hours from receipt of the order. If any defects or discrepancies are found with your order, you must notify us of the issue by completing our order dispute form on our website. All submitted disputes are reviewed within 24 to 48 hours of submission, except on weekends and holidays. All communication regarding disputes will be handled via email if it’s determined that we are at fault for any issue reported. Detailed instructions on how to handle the product and process will be provided to the customer via email.
Returns/Reimbursement
Eternal Designs does not accept returns on any garments or items that have been approved, paid for, and printed exactly as requested.
If defects or discrepancies are identified, you must notify Eternal Designs by submitting an Order Dispute Form (Click HERE). All claims are reviewed on a case-by-case basis.
Items submitted for review must be returned unworn, unwashed, and unused for inspection. Shipping responsibility and any covered shipping costs will be determined at the time the claim is reviewed.
For any dispute requiring the return of items, all affected items must be returned together. Partial returns will be placed on hold until all required items are received. If required items are not returned within ten (10) days of claim approval, the dispute request—including any request for a full refund—may be denied.
Upon inspection, Eternal Designs will determine whether the order qualifies for reimbursement or replacement.

Approved reimbursements are processed within 10 business days.

Approved replacements are placed into production within an estimated 10–12 business days of claim approval. Production timelines are estimates and are not guaranteed.
Partial returns that qualify for reimbursement will be issued as account credit. Credit-supplied items are non-returnable and non-refundable.
Any items returned for reimbursement or replacement become the property of Eternal Designs.
Misprint Allowance/Spoilage
We work hard to minimize misprints during the print process. Unfortunately, this is not something we are always able to prevent. Eternal Designs maintains a 3% spoilage/misprint allowance rate per design. If misprints happen within the allowed spoilage percentage, Eternal Designs reserves the right to refuse account credit or reprints of misprinted garments. These orders are considered acceptable. For orders with a misprint allowance of over 3%, Eternal Designs may either reprint the misprinted items or credit your account for the misprinted items. If an exact quantity is required, we strongly suggest ordering extra garments for your project. Due to the complexity of the screen-printing process, we are unable to reprint a single item.
Intellectual Property & Artwork Ownership
By using Eternal Designs’ services, you represent and warrant that you own, have legally licensed, or otherwise have the full right and authority to reproduce, manufacture, and use all artwork, designs, logos, or materials you provide to us (collectively, “Customer Artwork”).
You grant Eternal Designs, its websites, contractors, and service providers a royalty-free, non-exclusive, transferable, and sublicensable license to use Customer Artwork solely for the purpose of producing your order and performing services requested by you.
You are solely responsible for all Customer Artwork submitted. You represent and warrant that such artwork does not infringe upon any copyright, trademark, patent, moral right, right of publicity, or other intellectual property or proprietary right of any third party.
Eternal Designs reserves the right, in its sole discretion, to review, refuse, or reject any artwork that is false, misleading, inaccurate, incomplete, defamatory, obscene, pornographic, indecent, harassing, threatening, abusive, inflammatory, invasive of privacy or publicity rights, or otherwise objectionable or unlawful.
Eternal Designs is not responsible for any product created from Customer Artwork that violates these Terms or applicable laws. We will not reproduce, distribute, or sell Customer Artwork for purposes outside your project without your prior written authorization.
Original Works Created by Eternal Designs
Any original artwork, designs, concepts, layouts, mockups, proofs, graphics, logos, illustrations, motion graphics, or other creative materials created by Eternal Designs (“Original Works”)—whether in digital or physical form—remain the exclusive intellectual property of Eternal Designs, unless otherwise agreed to in writing.
Original Works may be used for production, approvals, internal records, portfolio presentation, marketing, promotional materials, or business development by Eternal Designs unless otherwise restricted in writing.
Requests to transfer ownership or grant extended rights to Original Works will be reviewed on a case-by-case basis. Eternal Designs reserves the right to approve or deny such requests at its sole discretion.
Limited License for Client Marketing Use
Upon full payment and completion of a project, Eternal Designs grants the customer a limited, non-exclusive, non-transferable license to use approved final artwork files solely for marketing and promotional purposes related to the specific completed project.
This limited license:
- Is valid for a period of six (6) months from the project completion date
- Applies only to marketing, promotional, or portfolio use directly related to the completed project
- Does not permit resale, redistribution, sublicensing, modification, or use on future projects

Does not transfer ownership of the artwork or Original Works
Any use beyond this scope or timeframe requires prior written approval from Eternal Designs.
No Transfer of Intellectual Property
Nothing in these Terms shall be construed as transferring or assigning any intellectual property rights of either party to the other, except for the limited licenses expressly stated above.
Third-Party Supplier Products
Eternal Designs offers an assortment of products that are outsourced to a group of qualified industry vendors. These products include but are not limited to promotional products (cups, pens, keychains, lanyards, etc.), paper products (business cards, envelopes, letterhead, invitations, etc.), patches (leather, woven, PVC, etc.), woven labels, sublimated uniforms, retractable banners, stickers (Clear, holographic), and static clings.
With the production of these products being handled outside of our facility, additional time must be factored in when placing your order. Eternal Designs will do our best to provide you with the most accurate delivery date for your product. Due to any possible unforeseen issues like bad weather, natural disasters, or mechanical problems, we cannot guarantee any estimated delivery date we provide.
When providing digital proofs, we do our best to provide you with the most accurate proof using the actual product, sizing, and Pantone colors. Please note that all digital colors viewed on your computer screen or mobile device are approximate and are close to the actual product.
Water-based and Specialty inks
The use of discharge ink is suggested for 100% cotton garments only. Standard water-based ink can be printed on cotton and blends. Due to the inconsistent nature of discharge printing, Eternal Designs is not responsible for variations found in the print. Refunds will not be issued because of these variations. Exact Pantone matching can be difficult depending on the garment, although we will work to get as close as possible. Exact color matching is not guaranteed. If you choose this printing method, be aware that there is a high chance of spoilage due to issues that may arise during the discharge process. Customers should consider adding extra garments for this purpose. Customers should consider adding extra garments for this purpose. Note: With the use of water-based and discharge inks, there will be a small amount of washout, which will cause the print to fade slightly over time. We are not responsible for fading prints or weathered goods. Garments with foil, metallic inks, or other specialty bases and embellishments should be washed inside out to maximize the washability and longevity of the print.
Color Matching
If you require that we match the colors in your design to the actual color, we print on your garment. You must provide us with the actual Pantone number for every color in your design. These numbers must come from the Pantone Coated or Uncoated book. No other color from any other Pantone book will be accepted. If we are provided artwork by a customer that does not specify a Pantone number, Eternal Designs will choose the closest color to match what we see on screen. Ink colors may vary depending on the print method used and the garment type and blend. Eternal Designs is not responsible for the color variances of any print where the Pantone number was not stated clearly at the beginning of the project.
Eternal Stores
Eternal Designs provides a custom online store service known as “Eternal Stores.” Eternal Stores allows schools, churches, clubs, nonprofit organizations, businesses, teams, and individuals to offer branded goods through an online storefront operated and fulfilled by Eternal Designs. Use of Eternal Stores is subject to these Terms and any additional requirements established by Eternal Designs.
For purposes of these Terms, the following definitions apply:
“Eternal Store” or “Store” refers to an online storefront created, managed, or fulfilled by Eternal Designs through the Eternal Stores service. A “Store Organizer” is the individual, business, school, team, organization, nonprofit, or other group that requests or is responsible for establishing an Eternal Store. If an individual is acting on behalf of an organization, that person is considered an authorized representative of the Store Organizer. A “Campaign” is a designated ordering period during which an Eternal Store is open, and products are available for purchase. A “Store Type” refers to the category or purpose of an Eternal Store, which may include, without limitation, retail stores, organizational stores, team or group stores, promotional stores, or fundraising stores, depending on the structure and intent of the Store Organizer and the configuration of the Store. A “Purchaser” is anyone who places an order, submits payment, or purchases branded goods through an Eternal Store. A “User” is anyone who visits, browses, interacts with, or otherwise uses an Eternal Store, whether or not they make a purchase.
For purposes of these Online Store Terms, references to “you” or “your” include Store Organizers, Purchasers, Users, and any other person or entity accessing or using Eternal Stores, as applicable to the context. By accessing, establishing, approving, purchasing through, or otherwise using an Eternal Store, you agree to be bound by these Terms and any applicable store-specific requirements, policies, or written agreements established by Eternal Designs.
Age & Eligibility
To establish, approve, or administer an Eternal Store, you must be at least eighteen (18) years of age and legally capable of entering into a binding agreement. If you are establishing or administering an Eternal Store on behalf of a business, school, team, nonprofit organization, church, club, or other entity, you represent that you are authorized to act on behalf of and bind that entity to these Terms.
Individuals under eighteen (18) years of age may not independently establish, approve, or administer an Eternal Store or receive a fundraising payout in their individual capacity. A minor may purchase branded goods through an Eternal Store with the permission and supervision of a parent or legal guardian. By permitting a minor to use or purchase through an Eternal Store, the parent or legal guardian accepts responsibility for the minor’s use of the Store and compliance with these Terms.
By establishing, approving, administering, purchasing through, or otherwise using an Eternal Store, you represent that you meet the age and eligibility requirements applicable to your use of the service.
Eternal Designs reserves the right to request information or documentation reasonably necessary to verify age, identity, organizational authority, or eligibility. If information provided to Eternal Designs is inaccurate, misleading, incomplete, or cannot reasonably be verified, Eternal Designs may refuse to establish or launch a Store, restrict or suspend access to a Store, close a Store, or withhold an applicable payout until the matter has been resolved.
Submitted Content & Intellectual Property
Store Organizers may provide Eternal Designs with logos, artwork, photographs, graphics, trademarks, names, slogans, designs, or other content for use in connection with an Eternal Store (“Submitted Content”). By providing Submitted Content, the Store Organizer represents and warrants that they own the Submitted Content or have obtained all rights, licenses, permissions, and authorizations necessary for Eternal Designs to use, reproduce, modify, display, print, decorate, distribute, and otherwise use the Submitted Content as required to create, operate, promote, produce, and fulfill the Eternal Store.
Submitted Content may not infringe or violate any copyright, trademark, right of publicity, right of privacy, or other intellectual property or proprietary right of any third party. Submitted Content may also not contain unlawful, fraudulent, defamatory, obscene, discriminatory, threatening, hateful, or otherwise prohibited material.
The Store Organizer remains responsible for obtaining and maintaining any permissions, licenses, or approvals required for Submitted Content. Eternal Designs is not responsible for independently verifying ownership of or rights to Submitted Content before accepting or using it.
By providing Submitted Content, the Store Organizer grants Eternal Designs a non-exclusive right to use, reproduce, adapt, resize, format, display, and otherwise process the Submitted Content as reasonably necessary to design branded goods, create and operate the Eternal Store, fulfill orders, and provide the related Services. Providing Submitted Content does not transfer ownership of the Store Organizer’s underlying intellectual property to Eternal Designs.
Eternal Designs reserves the right to reject, remove, modify, suspend, or discontinue the use of any Submitted Content or branded goods that Eternal Designs reasonably believes may violate these Terms, infringe the rights of another party, create legal or reputational risk, or otherwise be inappropriate for use through Eternal Stores. Eternal Designs may also suspend the affected Store or branded goods while ownership, authorization, or other rights are being verified.
Fraud & Misrepresentation
Fraudulent, deceptive, or misleading activity in connection with an Eternal Store is strictly prohibited. All information provided to Eternal Designs in connection with the creation, operation, promotion, purchase, or administration of an Eternal Store must be accurate, complete, and not reasonably likely to mislead Eternal Designs, Purchasers, or any other party.
Store Organizers may not falsely represent their identity, authority, affiliation, relationship with another individual or organization, purpose of a Store, intended beneficiary, or use of fundraising proceeds. Store Organizers are also responsible for providing accurate payment, payout, tax, and organizational information when such information is requested by Eternal Designs.
Purchasers and Users may not use stolen or unauthorized payment information, knowingly submit false payment or order information, abuse chargeback or dispute procedures, impersonate another person or organization, or otherwise use Eternal Stores for fraudulent or unlawful purposes.
If Eternal Designs reasonably suspects fraudulent, deceptive, unauthorized, or unlawful activity, Eternal Designs may request additional information or documentation, suspend or close the affected Store, cancel or restrict orders, delay or withhold fundraising payouts, restrict access to Eternal Stores, or take other actions reasonably necessary to investigate or protect Eternal Designs, Purchasers, Store Organizers, or affected third parties.
Store Organizers agree to reasonably cooperate with requests for information or documentation necessary to verify compliance with these Terms. Where appropriate and permitted by law, Eternal Designs may provide relevant information to payment processors, financial institutions, affected organizations or beneficiaries, law enforcement, or other parties involved in investigating suspected fraudulent or unlawful activity.
Eternal Designs reserves the right to recover from the responsible party any losses, fees, chargebacks, penalties, refunds, or other costs incurred as a result of fraudulent, deceptive, or unauthorized activity.
Store Setup, Review & Approval
With the submission of the Eternal Stores intake form, the process of establishing an Eternal Store begins with the information, artwork, product preferences, and other materials requested by Eternal Designs. Eternal Designs will use the information provided by the Store Organizer to determine the Store configuration, recommend appropriate branded goods, develop applicable designs, and prepare the Store for review.
Store setup is generally completed within approximately one (1) week after Eternal Designs receives all information and materials necessary to begin the project. Any stated setup or launch timeframe is an estimate only and may vary based on the complexity of the Store, product availability, artwork requirements, requested revisions, response times, or other circumstances affecting completion.
Before a Store is launched, the Store Organizer will be given an opportunity to review the Store and confirm the accuracy of its contents. This review may include, as applicable, branded goods, designs, pricing, product descriptions, Store information, fundraising details, shipping or pickup instructions, third-party links, and other Store-specific information.
The Store Organizer is responsible for carefully reviewing all Store information before providing approval. Approval of the Store authorizes Eternal Designs to launch the Store and confirms that the Store Organizer accepts the information, configurations, and terms presented at the time of approval.
Eternal Designs may require corrections, additional information, or changes before launching a Store and reserves the right to decline, delay, or discontinue a Store that does not satisfy Eternal Designs’ operational, production, legal, or other applicable requirements.
Campaign Periods & Store Availability
Each Eternal Store Campaign will operate for a designated ordering period established before the Store is launched. Unless otherwise approved by Eternal Designs, Campaigns are generally scheduled to remain open for approximately two (2) weeks. Longer Campaign periods may be permitted based on the needs of the Store Organizer; however, Eternal Designs generally recommends that Campaigns not exceed three (3) weeks.
The opening and closing dates for each Campaign will be communicated to the Store Organizer before launch. The Store Organizer is responsible for reviewing and approving those dates as part of the Store approval process.
Requests to extend, shorten, reopen, or otherwise modify an active Campaign are subject to approval by Eternal Designs and may be limited by production schedules, product availability, fulfillment requirements, or other operational considerations. Eternal Designs does not guarantee that a Campaign can be extended or reopened after its established closing date.
Once a Campaign closes, the Store will no longer accept new orders unless otherwise authorized by Eternal Designs. Orders submitted and successfully processed before the closing deadline will be included in the Campaign for purposes of production, fulfillment, applicable order minimums, and fundraising calculations.
Eternal Designs reserves the right to temporarily suspend, close, or modify a Campaign when reasonably necessary due to product availability, technical issues, suspected fraud, legal or compliance concerns, production limitations, or other circumstances affecting the operation or fulfillment of the Store.
Product Availability & Supply
Branded goods offered through an Eternal Store are selected based on product suitability, anticipated demand, vendor availability, and current inventory conditions. Product availability is subject to change and is not guaranteed until orders are placed and inventory is secured for production.
Eternal Designs relies on third-party manufacturers, distributors, and suppliers for many of the branded goods offered through Eternal Stores. As a result, certain products, colors, sizes, or styles may become unavailable, discontinued, delayed, or otherwise affected by circumstances outside of Eternal Designs’ control.
If a selected product becomes unavailable before production, Eternal Designs may, when reasonably necessary, recommend or substitute a comparable product of similar style, quality, color, or value. When a substitution would materially affect the appearance, quality, or intended use of the branded goods, Eternal Designs may contact the Store Organizer before proceeding.
Product availability, supplier pricing, shipping costs, and other market conditions may also affect the products or pricing available for future Campaigns. Eternal Designs reserves the right to modify product selections or pricing before a Store or subsequent Campaign is approved and launched.
Eternal Designs is not responsible for delays, substitutions, or product unavailability caused by manufacturers, distributors, suppliers, shipping carriers, supply shortages, discontinued products, or other circumstances outside of Eternal Designs’ reasonable control.
Order Minimums
Unless otherwise approved or established in writing by Eternal Designs, Eternal Stores offered branded goods are subject to a minimum Campaign order quantity of twenty-four (24) total items. The minimum is calculated based on the combined quantity of eligible items ordered through the Campaign.
If a Campaign reaches twenty-four (24) or more total items, eligible orders will proceed to production and fulfillment in accordance with these Terms. For Fundraising Stores, applicable fundraising proceeds will be calculated and paid to the Store Organizer as provided in the Fundraising Stores & Payouts section. For all other Store types, production and fulfillment will proceed in accordance with these Terms.
If a Campaign receives between fifteen (15) and twenty-three (23) total items, Eternal Designs will generally proceed with production and fulfillment. For Fundraising Stores, any fundraising proceeds that would otherwise be payable to the Store Organizer may be retained by Eternal Designs to offset the additional production and fulfillment costs associated with the Campaign not reaching the required minimum. For all other Store types, production and fulfillment will proceed in accordance with these Terms.
If a Campaign receives fewer than fifteen (15) total items, Eternal Designs reserves the right, based on the scope and production requirements of the Store, to cancel production and fulfillment of the Campaign. This provision applies to both Fundraising Stores and non-fundraising Stores. If Eternal Designs elects not to produce the orders, Purchasers will receive refunds for amounts paid toward their orders. Any payment processing fees incurred by Eternal Designs that are not refundable to Eternal Designs may be charged to the Store Organizer.
Stores containing more than six (6) branded goods, specialty products, or other production requirements may be subject to different or additional minimums established by Eternal Designs before the Store is approved and launched.
Meeting the applicable minimum order quantity is the Store Organizer's responsibility. Eternal Designs does not guarantee the number of orders, sales volume, participation, or fundraising proceeds generated by an Eternal Store.
Production & Fulfillment
After a Campaign closes, Eternal Designs will review and consolidate the eligible orders received through the Store. This process may include confirming product quantities, order totals, applicable taxes, shipping charges, fulfillment requirements, and fundraising proceeds, where applicable.
Production generally begins after the Campaign has closed, applicable order minimums have been satisfied or otherwise approved, payments have been successfully processed, and the Campaign has been reviewed for production.
Production and fulfillment are generally completed within approximately two (2) weeks after the Campaign closes. All production and fulfillment timeframes are estimates and may vary based on order volume, product availability, decoration requirements, supplier delays, shipping conditions, holidays, or other circumstances affecting production or delivery.
Depending on the fulfillment method established for the Store, completed orders may be shipped directly to individual Purchasers, packaged for individual or group pickup, delivered to a designated location, or fulfilled through another arrangement approved by Eternal Designs.
The fulfillment method, pickup instructions, shipping charges, and other applicable delivery information will be established as part of the Store setup and approval process. Purchasers are responsible for providing accurate shipping and contact information when placing an order.
Eternal Designs may combine, separate, sequence, or otherwise organize production and fulfillment in the manner reasonably necessary to efficiently complete Campaign orders. Eternal Designs does not guarantee that all orders from the same Campaign will be completed, shipped, delivered, or made available for pickup on the same date.
Orders are subject to the product availability, shipping, production, and other applicable provisions contained in these Terms.
Fundraising Stores & Payouts
Fundraising payouts apply only to Eternal Stores established and approved as Fundraising Stores. The amount available for payout is determined by the pricing structure established for the Campaign and the eligible sales completed through the Store.
For each eligible branded good offered through a Fundraising Store, Eternal Designs will establish the applicable base cost or other agreed cost structure. The Store Organizer may then establish or approve the final selling price in accordance with the pricing options provided by Eternal Designs. The difference between the applicable selling price and the costs associated with producing and fulfilling the order will determine the fundraising proceeds generated by the Campaign.
Fundraising proceeds are calculated after applicable production costs, payment processing fees, taxes, fulfillment fees, shipping costs, refunds, chargebacks, and any other costs or adjustments associated with the Campaign have been accounted for. Only the remaining eligible fundraising proceeds will be payable to the Store Organizer or approved payee.
Fundraising payouts are also subject to the minimum order requirements established in these Terms. A Campaign that does not reach the applicable minimum may result in a reduction or forfeiture of fundraising proceeds as provided in the Order Minimums section.
Payouts are issued on the first (1st) and fifteenth (15th) of each month after the applicable Campaign has closed, orders and payments have been reconciled, and all information required to issue the payout has been received and verified by Eternal Designs.
The Store Organizer is responsible for providing accurate payout information, including the name of the individual or organization to whom the payout should be made. If the payout recipient differs from the Store Organizer or the contact identified during Store setup, Eternal Designs may require the recipient’s full name, mailing address, telephone number, and any other information reasonably necessary to process or verify the payout.
Eternal Designs is not responsible for delayed, returned, or misdirected payouts resulting from inaccurate, incomplete, or outdated information provided by the Store Organizer or payout recipient.
Eternal Designs may temporarily delay or withhold a payout when reasonably necessary to investigate suspected fraud, chargebacks, disputed transactions, payment issues, inaccurate information, violations of these Terms, or other circumstances that may affect the accuracy or validity of the payout. Any eligible amount remaining after such matters are resolved will be processed in accordance with these Terms.
Customer Support
Eternal Designs serves as the primary point of contact for customer service matters related to orders placed through Eternal Stores. Purchasers with questions regarding an order, payment, production status, shipping, pickup, defects, or other Store-related matters should contact Eternal Designs using the contact information provided on the applicable order confirmation, invoice, or Store.
Store Organizers are not required to manage individual Purchaser service requests unless otherwise agreed upon with Eternal Designs. Eternal Designs may communicate directly with Purchasers as reasonably necessary to review, resolve, or provide information regarding an order or Store-related concern.
Purchasers are responsible for providing accurate and current contact information when placing an order and for responding to requests for additional information when reasonably necessary to resolve an issue.
Customer service requests involving defects, damaged goods, returns, exchanges, refunds, shipping issues, or other order-related claims remain subject to the applicable provisions, deadlines, and limitations contained elsewhere in these Terms.
Eternal Designs reserves the right to determine the appropriate method of resolution for customer service matters in accordance with these Terms and the circumstances of the applicable order.
Third-Party Links
An Eternal Store may, when approved by Eternal Designs, include links to third-party websites, platforms, or services (“Third-Party Links”) provided for convenience or at the Store Organizer’s request. These links do not imply any ownership, control, endorsement, sponsorship, or affiliation by Eternal Designs.
Eternal Designs is not responsible for the content, availability, accuracy, security, or practices of any third-party site, and Users access such links at their own risk. Users are responsible for reviewing and complying with the applicable third party’s terms, policies, and conditions before engaging with them.
Eternal Designs is not liable for any loss, damage, or dispute arising from a User’s interaction with any third-party website, product, or service. Eternal Designs may remove or disable any Third-Party Link at its discretion if it is deemed inappropriate, unsafe, or inconsistent with these Terms.
Store Suspension, Cancellation & Closure
Eternal Designs reserves the right to delay, suspend, cancel, close, or refuse to launch an Eternal Store when reasonably necessary due to suspected fraud, violations of these Terms, intellectual property concerns, payment issues, product or supply limitations, legal or compliance concerns, inaccurate or incomplete information, or other circumstances that may affect the proper operation or fulfillment of the Store.
A Store Organizer may request that a Store or Campaign be cancelled, suspended, or closed; however, any such request is subject to the status of existing orders, production commitments, payment obligations, and other costs already incurred by Eternal Designs.
If a Store or Campaign is cancelled before production begins, Eternal Designs will determine the appropriate handling of existing Purchaser orders, refunds, processing fees, fundraising proceeds, and other outstanding obligations in accordance with these Terms and the circumstances of the Store.
Once production has begun, orders generally may not be cancelled, and any applicable refund or cancellation rights will remain subject to the provisions contained elsewhere in these Terms.
Eternal Designs may temporarily suspend a Store while investigating suspected fraud, unauthorized activity, intellectual property disputes, payment concerns, or other potential violations. During a suspension, Eternal Designs may restrict new orders, delay production or fulfillment, withhold applicable payouts, or take other reasonable steps until the matter is resolved.
Closing or terminating an Eternal Store does not eliminate any payment obligation, liability, reimbursement requirement, or other responsibility that arose before the Store was closed.
Relationship to Existing Terms
These Eternal Stores Terms are intended to supplement the general Terms & Conditions of Eternal Designs and apply specifically to the creation, operation, use, purchase, production, fulfillment, and administration of Eternal Stores.
Except where these Eternal Stores Terms expressly provide otherwise, all other applicable provisions of the Eternal Designs Terms & Conditions remain in full force and effect, including provisions related to payment, artwork, production, shipping, returns, exchanges, intellectual property, disputes, limitations of liability, and other applicable Services.
If a provision of these Eternal Stores Terms conflicts directly with a general provision contained elsewhere in the Eternal Designs Terms & Conditions, the provision that specifically governs Eternal Stores will control with respect to the applicable Eternal Store, Campaign, order, or transaction.
Store-specific requirements, written agreements, approved exceptions, or additional conditions provided by Eternal Designs may also apply when expressly communicated to and accepted by the Store Organizer.
Nothing in these Eternal Stores Terms limits any right, remedy, protection, or obligation otherwise available to Eternal Designs under the broader Terms & Conditions or applicable law.
Marketing
All works, including but not limited to artwork, logos, mockups, graphics, and production prints, are subject to being used in any and all audio-visual, sound recording, and literary works for advertising and demonstration purposes by Eternal Designs unless otherwise instructed. Any unauthorized use of any published content is strictly prohibited.
Shop Hours
Our shop is open from 9:00 AM – 4:00 PM Monday – Thursday and 9:00 AM – 1:00 PM on Friday. We can be reached by phone during normal office hours. You can contact us via email anytime. Note: emails will only be answered during office hours. Eternal Designs reserves the right to change/modify daily hours of operation without notice.

Email & Text Message Communications
Introduction and Scope
Eternal Designs communicates with customers through email and text message (SMS) to provide important updates and information related to your orders, production status, shipping or pickup notifications, and promotional offers. These communications are intended to enhance your experience and keep you informed throughout the order and production process.
Information Collected
To facilitate these communications, Eternal Designs may collect and process certain contact information, including:

- Mobile phone number
- Communication preferences
- Order or transaction history (as it relates to service communications)
This information may be provided through order checkout forms, customer account creation, post-purchase invitations, promotional sign-ups, or direct communication with our team.
Purpose and Use

- Send order confirmations, artwork approvals, production updates, and shipping notifications.
- Deliver marketing and promotional messages when consent has been provided.
- Personalize messages based on your order history or preferences.

Enrollment in text or email communications is voluntary and requires customer consent, which may be provided during checkout, through Eternal Designs’ digital forms, or via post-purchase invitations.
You may opt out of text messages at any time by replying STOP to any message or by contacting us directly. Marketing emails include an “Unsubscribe” link that allows you to manage or discontinue promotional communications at any time.
Eternal Designs promptly honors all opt-out requests and ensures that customer communication preferences are accurately updated across our systems.
Portal Access
Access to the Portal is provided to approved Eternal Designs customers. You are responsible for maintaining the confidentiality of your Client ID. We strongly discourage sharing your Client ID with any third party to ensure that order information, artwork, and payment details remain secure.
Any activity conducted through your Portal access will be treated as authorized by you.
Permitted Use
The Portal is provided for business purposes related to your Eternal Designs orders, including but not limited to:

You agree to use the Portal only for lawful, authorized, and business-related purposes.
Order Approvals & Production Authorization
Any approval submitted through the Portal constitutes your formal authorization for Eternal Designs to proceed with production.
Once an order is approved, Eternal Designs is not responsible for errors that were visible or contained within the approved proof, including but not limited to spelling, layout, color, sizing, or placement.
Payments & Transactions
The Portal may be used to submit payments and deposits toward your orders. All payments are subject to Eternal Designs’ standard payment terms and policies.
You represent that you are authorized to use the payment method provided. Eternal Designs is not responsible for delays, processing errors, or interruptions caused by third-party payment processors.
Messaging & Communication
The Portal messaging feature is provided to facilitate project-related communication. Messages transmitted through the Portal become part of your order record and may be retained for operational, legal, and quality assurance purposes.
Intellectual Property & Artwork
All artwork, proofs, and design files made available through the Portal remain subject to Eternal Designs’ intellectual property terms.
Unless otherwise agreed to in writing, Eternal Designs retains ownership of original design work created on your behalf. Use of any artwork beyond the scope of your order requires prior written authorization.
Data Accuracy & Availability
While we strive to provide accurate and current information, the Portal is provided on an “as-is” and “as-available” basis. Eternal Designs does not guarantee uninterrupted access, error-free operation, or real-time data accuracy.
Security & Misuse
You agree not to:

Attempt to gain unauthorized access to the Portal

Share your Client ID for improper or unauthorized purposes

Interfere with the Portal’s operation or security

Upload or transmit harmful, unlawful, or infringing content
Eternal Designs reserves the right to suspend or terminate Portal access for misuse or violation of these Terms.
Limitation of Liability
To the fullest extent permitted by law, Eternal Designs shall not be liable for any indirect, incidental, consequential, or business interruption damages arising from your use of the Portal.
Privacy and Data Handling
Your contact information is securely stored and used exclusively for communication purposes in connection with Eternal Designs’ services. We do not sell or share your information with unaffiliated third parties for their own marketing use.
